Enrolment Terms & Conditions
These Terms & Conditions form a binding agreement between Klangfarben Creative Pty Ltd (“Klangfarben Creative”, “we”, “our”) and the enrolling parent or legal guardian (“you”).
By enrolling a student in any Klangfarben Creative program (including Small Group Instrument Lessons, BAM Before & After School Music, or Ensemble programs), you acknowledge and agree to the following:

1.1 Enrolment constitutes acceptance of these Terms & Conditions.
1.2 Enrolment secures a position in a specific program at a fixed weekly day and time for the duration of the published Klangfarben Creative school term.
1.3 Fees are charged for securing and maintaining that reserved position within the program, not for attendance at individual sessions.
1.4 Programs operate with capped enrolment numbers and fixed staffing allocations. A student’s place cannot be reallocated due to absence.

2(a) Small Group Instrument Lessons
2.1 Each school term consists of ten (10) weeks.
2.2 Weeks 1–9 are regular scheduled teaching weeks.
2.3 Week 10 is reserved exclusively for:
• Approved make-up lessons (subject to Clause 6); and/or
• Teacher administration and student progress reporting.No regularly scheduled lessons will occur during Week 10.
2.4 Students are charged for nine (9) teaching weeks per term.
2(b) BAM Before & After School Music
2.5 BAM programs operate across all ten (10) weeks of the published term.
2.6 Students are charged for ten (10) teaching weeks per term.
2.7 No make-up sessions are provided for BAM programs.
BAM fees are calculated based on the number of enrolled sessions per week. Each enrolled session reserves a position within that specific BAM program for the full term.
2(c) Ensemble Programs (Choir, Strings & Group Programs)
2.8 Ensemble programs operate across all ten (10) weeks of the published term.
2.9 Students are charged for ten (10) teaching weeks per term.
2.10 No make-up sessions are provided for Ensemble programs.
2(d) All Programs – Schedule & Calendar
2.11 Where public holidays, pupil-free days, or calendar variations affect a student’s usual session day, the number of scheduled program weeks within Weeks 1–10 may vary.
For example, where a public holiday falls on a student’s usual session day, that session will not occur.
The confirmed teaching and program schedule for each term will be published at least four (4) weeks prior to the commencement of that term.
2.12 Public Holidays & Pupil Free Days
No regularly scheduled sessions will occur on Queensland public holidays or designated pupil-free/student-free days as determined by Klangfarben Creative.These dates are factored into the published term schedule. Term fees are set accordingly and are not adjusted retrospectively due to such dates.
2.13 Published Term Calendar
The published Klangfarben Creative term calendar forms part of these Terms & Conditions and may be updated from time to time.2.14 Performances & Showcases
Performances and showcases may occur during the term as published in the confirmed schedule. -
3.1 Fees are payable for the full term in accordance with the selected payment method.
All instalment payments (term or weekly) are structured so that the full term fee is paid prior to the end of the published term. No instalments are scheduled beyond the conclusion of the term unless outstanding fees remain payable.
3(a) Term Payment
3.2 Term fees will be processed no later than seven (7) days prior to the published commencement date of the term.
A single consolidated term payment will be processed covering all programs, ensembles, and/or sessions in which the student is enrolled for that term.
Each term payment covers the upcoming term of enrolment across all booked programs.
Where additional programs are added after the term has commenced:
• Full payment for the remaining weeks of that term must be received prior to the student commencing in the additional program;
• Intent to pay does not secure or hold a position;
• Only cleared payment guarantees enrolment in the specific program.3(b) Weekly Direct Debit
3.4 Weekly payments will be processed no later than seven (7) days prior to each scheduled week and are charged one (1) week in advance.
A single consolidated weekly payment will be processed covering all programs, ensembles, and/or sessions in which the student is enrolled for that week.
Each weekly payment covers the upcoming week of enrolment across all booked programs.
Where additional programs are added after the week has commenced:
• Full payment for the upcoming week must be received prior to the student commencing in the additional program;
• Intent to pay does not secure or hold a position;
• Only cleared payment guarantees enrolment in the specific program.The first weekly payment may be processed prior to the student’s first session.
3(c) Bundle & Combination Pricing
Where a student is enrolled in bundled programs (including but not limited to AM BAM + PM BAM, PM BAM + Lesson, or AM BAM + PM BAM + Lesson combinations), discounted pricing may apply as set out in the published fee schedule.
Bundle pricing does not alter:
• The applicable absence policy for each program type;
• The term commitment;
• The payment structure set out in Clause 3.3(d) Enrolment Fee
A once-off $25 enrolment fee per student applies when a student first enrols in a Klangfarben Creative program.
The enrolment fee contributes to program onboarding, administrative setup, and learning resources.
The enrolment fee:
• applies once per student upon first enrolment
• is capped at $75 per family
• is non-refundableStudents who maintain continuous enrolment will not be charged the enrolment fee again.
3(e) Family & Sibling Discounts
Where multiple children from the same immediate family are enrolled concurrently in Klangfarben Creative programs, the following discounts may apply:
• The second enrolled child receives a 5% discount on applicable program fees.
• The third and subsequent enrolled children receive a 10% discount on applicable program fees.Sibling discounts apply only while two or more children from the same family are actively enrolled at the same time.
Where a sibling enrols mid-term, the applicable discount will apply from the next billing cycle and will not be applied retrospectively to fees already billed or paid.
For the purposes of calculating sibling discounts:
• The highest applicable discount will be applied to the lowest program fee where multiple siblings are enrolled.
If a sibling withdraws or enrolment changes such that discount eligibility no longer applies, the applicable program fees will revert to the standard published rates from the next billing cycle.
Sibling discounts:
• apply only to tuition/program fees
• do not apply to enrolment fees, materials, events, or external costs
• cannot be combined with other promotional offers unless expressly stated.Klangfarben Creative reserves the right to verify eligibility for sibling discount

4.1 If payment is not received by the required processing date, Klangfarben Creative may:
• Issue a reminder notice;
• Suspend participation;
• Recover reasonable administrative costs.4.2 If a payment is declined, reversed, or dishonoured:
• The outstanding amount remains payable immediately;
• An administrative fee of $10 per failed transaction may be charged;
• Participation may be suspended until payment is rectified.4.3 Where fees remain unpaid for more than seven (7) days:
• Participation may be suspended;
• The reserved place may be forfeited;
• Reinstatement is subject to availability.Klangfarben Creative will generally provide written notice prior to suspension; however, immediate suspension may occur where payment remains outstanding beyond the stated timeframe.
Suspension does not relieve the obligation to pay:
• Outstanding accrued fees; and
• Fees for the remainder of the current term.4.4 Klangfarben Creative reserves the right to recover outstanding amounts through reasonable collection processes if necessary.

5(a) Small Group Instrument Lessons
5.1 A minimum of forty-eight (48) hours’ written notice is required for any absence, including but not limited to illness, school events, travel, personal commitments, extracurricular activities, timetable clashes, or unforeseen scheduling conflicts.
5.2 Where less than 48 hours’ notice is provided, the full lesson fee remains payable.
5.3 As fees secure a reserved position within a capped group, absences do not reduce fees.
5(b) BAM & Ensemble Programs
5.4 No make-up sessions, credits, or refunds are provided for non-attendance in BAM or Ensemble programs, regardless of notice provided and regardless of reason, including but not limited to illness, school events, travel, personal commitments, timetable clashes, or extracurricular activities.
As fees secure a reserved position within a capped program, absences do not reduce fees.

6.1 Each enrolled student in a Small Group Instrument Lesson is entitled to a maximum of one (1) make-up lesson per term.
6.2 Eligibility applies only where 48 hours’ written notice has been provided.
6.3 Make-up lessons:
• Must occur during Week 10 of the same term;
• Are subject to teacher availability;
• Do not carry forward;
• Are not refundable or creditable.6.4 No additional make-ups will be provided regardless of the number of absences.

7.1 BAM sessions will not ordinarily be cancelled due to teacher illness. A substitute facilitator or supervisor will be arranged.
7.2 Where Klangfarben Creative cancels a scheduled session in any program due to staff illness or unavoidable operational circumstances, we will use reasonable endeavours to:
• Provide a substitute teacher or facilitator;
• Deliver the session in an alternative format where appropriate (including, but not limited to, online delivery).7.3 Only where a session cannot reasonably proceed and no alternative format is provided may a credit be considered at the discretion of Klangfarben Creative.
7.4 This clause does not apply to public holidays, pupil-free days, or pre-advised term calendar variations.
7.5 This clause is subject to Clause 12 (Force Majeure).

8.1 Enrolment is for the full published Klangfarben Creative school term. Withdrawal during a term does not entitle you to any refund. All term fees remain payable once the term has commenced.
8.2 If you do not intend to continue into the following term, written notice must be provided prior to the final scheduled teaching day of the current term.
Example: If enrolled in Term 1 and not continuing into Term 2, written notice must be received before the final scheduled teaching day of Term 1.
8.3 Where notice is not received prior to the final scheduled teaching day of the current term and the new term has not yet commenced, Klangfarben Creative reserves the right to charge fees equivalent to the first two (2) scheduled sessions of the new term.
8.4 Where the new term has commenced prior to written notice being received, full term fees remain payable.
8.5 Enrolment will automatically continue into the next term unless written notice is provided in accordance with this clause.
8.6 Any outstanding fees for the current term must be paid in full, regardless of withdrawal, suspension, or forfeiture of place.
Failure to attend sessions does not relieve the obligation to pay fees for the reserved term.
Enrolment into a subsequent term will not proceed where outstanding fees remain unpaid.
Where fees have remained outstanding, continuation in the same program, day, or time is not guaranteed and is subject to availability.
8.7 If enrolment is suspended or withdrawn mid-term, the place is not guaranteed for future terms and reinstatement is subject to availability.

Requests for consideration due to serious hardship must be submitted in writing to the Director/s of Klangfarben Creative.
Such requests will be assessed confidentially and on a case-by-case basis.
Any variation granted:
• Is at the sole discretion of Klangfarben Creative;
• Is assessed case-by-case;
• Does not create a precedent. -
By enrolling and authorising payment, you acknowledge that:
• Fees secure a reserved position;
• All fees are payable in advance;
• Applicable absence policies differ by program type.Initiating a chargeback where fees are properly payable may constitute breach of contract.
Klangfarben Creative may provide enrolment confirmations, accepted Terms, attendance records, communication records, and policy documentation to payment providers in response to disputes.

Klangfarben Creative is not liable for cancellation, delay, or modification of sessions due to events beyond reasonable control, including but not limited to:
• Government directives;
• Public health restrictions;
• Extreme weather events;
• Natural disasters;
• Venue closure or damage;
• Industrial action;
• Utility failures;
• Acts of God.Where reasonably possible, sessions may be delivered online or via an alternative format. No refund applies where an alternative format is provided.

Students must participate respectfully and follow teacher direction.
Where behaviour compromises safety, group cohesion, or learning outcomes, Klangfarben Creative reserves the right to suspend or terminate enrolment.
Where appropriate, reasonable notice or warning will be provided prior to termination. Immediate suspension or termination may occur where behaviour poses a safety risk or serious disruption.
No refund applies where enrolment is suspended or terminated due to behavioural breach.

By submitting enrolment and completing payment, you expressly acknowledge that:
• You are entering into a binding agreement for the full term;
• Fees secure a reserved position and are not based on attendance;
• The applicable absence policy applies to the enrolled program type;
• Fees are payable in advance regardless of absence;
• You authorise Klangfarben Creative Pty Ltd to process payments in accordance with Clause 3.By completing enrolment and authorising payment, you confirm that you have reviewed the program details, fee structure, and attendance policies and that you understand charges relate to the reservation of a place within a capped program rather than attendance at individual sessions.
Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law.
